Fallacy. Most societies use several ideas to define crime and punish criminals and use all the reasons to justify and influence their policies on crime and punishment, not just one. Just because some are illogical it does not invalidate the logical policies. Just because some are based on morality rather than necessity it does not invalidate the policies based on necessity.
