Weaker societies punish more, and he theorized that a utopian, completely strong society wouldn't need to punish "transgressions" against the society at all. Skipping the abstract crap, and focusing on the first sentence, isn't that exactly what happened in USA post 9/11? They felt "weaker", and one by one the freedoms they promised were curbed.
