Good news Ohio! Federal Court Strikes Down Ohio Law Restricting Early Voting

In an opinion by Judge Peter Economus, a federal court agreed with the Obama campaign today that the Ohio anti-voter law must be suspended:

“A citizen has a constitutionally protected right to participate in elections on an equal basis with other citizens in the jurisdiction.” In Ohio, that right to participate equally has been abridged by Ohio Revised Code ‘ 3509.03 and the Ohio Secretary of State’s further interpretation of that statute with regard to in-person early voting. In 2005, Ohio expanded participation in absentee balloting and in-person early voting to include all registered Ohio voters. Now, “in-person early voting” has been redefined by the Ohio legislature to limit Plaintiffs’ access to the polls. This Court must determine whether preliminary injunctive relief should be granted to Plaintiffs on their claim that Ohio’s restriction of in-person early voti
ng deprives them of their fundamental right to vote. Following Supreme Court precedent, this Court concludes that Plaintiffs have stated a constitutional claim that is likely to succeed on the merits. As a result—and as explained below—this Court grants Plaintiffs’ motion for preliminary injunction.

The court’s opinion relies on the Supreme Court’s infamous decision in Bush v. Gore to reach this holding, citing Bush‘s statement that “having once granted the right to vote on equal terms, the State may not, by later arbitrary and disparate treatment, value one person’s vote over that of another.” Judge Economus’ decision will appeal to the United States Court of Appeals for the Sixth Circuit, a Republican-leaning court with a history of legally-challenged partisan decisions benefiting the Republican Party. So it remains to be seen whether Economus’ decision will have staying power.

There's something you have to understand about American Republicans today. Much like Clint Eastwood's routine with an invisible President Obama, there is an America only they can see: an America wherein the prosperity and values of the 1950s never quite ended. An America which consists entirely of a suburb in which houses with yards are contained by white picket fences (always white), with a family of a father who is the breadwinner and a mother who takes care of the children, of which there are always two (with one on the way!), and of course there is a dog named Spot/Rover/Fido. There is a roast in the oven, a Bible in the parlor, and a TV in the living room. This, a Republican says, is America, and they have spent so much time, over thirty years, telling themselves so, that anyone- anyone AT ALL, no matter how hateful, boring, or just plain revolting- who appeals to this vision, has their vote, and anyone who defies it (poors, homosexuals, foreigners, and anyone of a different race) is bent on america's destruction. Facts and figures fall before this vision. Why do you think so many political cartoonists made such a big deal about less Caucasian babies born in America, or still find any reason they can imagine to hate a black President? Most conservatives, I fear would genuinely take your comparison and interpret the other way, with Romney being blessed by the heavens and Obama as the herald of doom.

I've watched American political conventions before, but the stark differences in diversity were so much more pronounced than any that I've ever seen before.

The republican convention seemed to be entirely populated with wealthy looking old white people and a few suit-wearing young republicans with a very very few lonely token minorities occasionally showing up on the very edges of the crowd, while the democratic convention had absolutely everyone represented from every possible walk of life in America. It was really, really striking and a bit baffling that no-one seemed to even acknowledge it from the stage.

I was always bit doubtful when Americans talk about the radical shift in politics coming with the dying off of the boomer generation, but now I completely believe it. There's no way the republicans can even hope to survive in the next couple decades appealing to such a narrow demographic. At some point soon, they are going to have to change their political rhetoric or die out with their aging demographic, so if you are looking for something hopeful in the future look to that.

The answer is that the Republican Party has developed three means of bypassing the mainstream media and its fact-checkers.

- The first is by repeating big lies so often in TV spots - financed by a mountain of campaign money - that the public can no longer recall (if it ever knew) that the mainstream media and its fact-checkers have disproven them.

- The money is the result of a series of court decisions and regulatory changes, beginning with the Supreme Court's 2010 ruling in Citizens United vs. Federal Election Commission. Fully a quarter of the $350 million amassed by super PACs through the end of July came from just 10 donors, according to the Center for Responsive Politics, a nonpartisan group that tracks such spending. And most of that money is financing negative ads targeting President Obama and other Democrats.

- The second means the GOP has developed to protect its mistruths is discrediting the mainstream media - asserting that it's run by "liberal elites" who can't be trusted to tell the truth. "I am tired of the elite media protecting Barack Obama by attacking Republicans," Newt Gingrich charged at a Republican debate in January in what has become a standard GOP attack line. To be sure, the mainstream media hasn't always called it correctly. Initially it bought the Bush administration's claim that there were "weapons of mass destruction" in Iraq. But the mainstream media is at least committed to professional standards that separate truth from fiction, seek objective facts, correct errors and disseminate the truth.

- The third means the GOP uses to protect itself is its own media outlets - led by Fox News, Rush Limbaugh and his yell-radio imitators, book publisher Regnery and the editorial page of the Wall Street Journal, along with a right-wing blogosphere. Even if these outlets don't spread the lies directly, they can at least spread doubt about what's true. Together, these three mechanisms are creating a parallel Republican universe of Orwellian dimensions, where anything can be asserted, where pollsters and political advisers are free to create whatever concoction of lies will help elect their candidate and where "fact-checkers" are as irrelevant and intrusive as is the truth. Whether all this helps the Republican Party in 2012 is of less consequence than the larger danger it poses to America. Democracy cannot thrive when truth becomes irrelevant.

Should people who want Obama reelected freak out already? Not really, they just need to go back to Nate's post from 10/3 and notice that 2 points Romney gained post-debate are less than what Kerry gained on Bush and even less than what Mondale gained on Reagan (to be fair, Reagan's lead was huge pre- and post-debate).

While there are obvious differences here, this race is more like 2004, not 2008 (and for a good reason, Obama is an incumbent now). Same way Kerry had a lame convention ("reporting for duty" - seriously?). Same way Bush looked like a fish out of water in the first debate (Obama looked more like he'd rather be somewhere else, but impression was the same - not passionate about this). Same way vp debate was between an "experience statesman" (Cheney/Biden) against a much younger upstart (Edwards/Ryan). Even the main incumbent message has similar mechanics - "we kept you safe from terrorists" vs "we saved you from economic calamity". So perhaps this race will follow the same pattern in its last month - incumbent regaining ground in further debates and just holding to large enough margin to win by electoral college.
