He could've gotten a divorce without her consent, in that case. Any question of whether she would recover would be irrelevant, because she was clearly incapacitated at that time. Michael Schiavo was her legal guardian and had power of attorney over her, so he could've divorced her at any time he wanted.

Besides, there WASN'T any serious question of whether she could recover. The chances of recovering after mere MONTHS in a persistent vegetative state are infintesimal. She'd already been in one for 7 years when Michael decided the tube should be removed. Her cerebral cortex had liquefied. Aside from divine intervention, there's no damn way anyone can recover from that.
