Regardless of whether you give up the passwrod they will have 45 days before you go to trial and while you're waiting for your court date the feds all the time in the world to take your drive apart.
Even if you go to trial and get found innocent, many months and 10's of 1000s of dollars later, good luck getting your gear back. Don't even think of letting a Public Defender represent you; they'll just tell you to plead or take the plea bargin.
That's one hell of a lot of hassle just to prove a point don't you think?
Wouldn't it be easier to not save anything incriminating in the first place?
