Computer Repair Legal Help

Name: Anonymous 2011-07-13 18:20

Hello /g/. I am considering starting up a small 'freelance' thing on the side for computer repair. I currently have both my CompTIA Essentials and Practical Applications license. A friend of my who isn't very... savvy with computers is insisting that I draft a legal contract for every and any computer work that I do, claiming that technicians are being sued left and right. I know that covering your ass is always a good idea and some imbecile might get there computer repaired, break it by derping, and then try to pin it on me in a civil court case. Or so I have been told. As much as I hate listening to people talking about shit outside of there field of practice, especially if they have no experience in it whatsoever, I want /g/'s opinion.

Tldr: Should I make clients sign contracts before I fix or look at there computer.

What might be best is to tell your customers what you're not responsible for, and possibly post it on a wall.

Then, simply make a reference to those terms and conditions on the receipt - there's no need to make them sign a legal waiver like you do at a doctors office, that's simply strange.

I think you should just get an insurance.
The problem with doing that is that it will cost you more that you earn.

My friend has solved the problem by only making home visits and never taking any hardware with him home from his customers.
That way he minimizes the risk that he could be held responsible for breaking someones hard drive or similar, but it also limits the amount of service he can deliver.

Don't change these.
