Need help with microphone

I have a cellphone hands free headset that fits into my xbox controller. Outside of games it records and plays back sounds. For instance in a party or when sending messages to other users it works fine. However inside games it does not work at all unless I have the people I am playing with join a party. I have tried a few games to test this.

Does Microsoft make it so that only their brand headsets work correctly with their games? Anyone know of a way around this (asside from getting a real microsoft headset)
