Cell phone tethering and the TOS

I'm about to spend a some money and get a decent phone with unlimited internet. I'm probably slowpoke on this but I have two questions...

    1- Are there any companies that have a reasonable tether plan, where you can use the phone as a bluetooth modem to get online.

    2- Barring that, if I were to go against the TOS and OCCASIONALLY (2x a day) check my email or something, would the cell phone company be able to tell?

I'm prompted to ask by that dumbfuck in canada who got hit with the $10,000 cell phone bill.
