Earlier there was a discussion in /g/ about how to protect your movies/music/anime that you may of hypothetically downloaded illegally from the MPAA/RIAA. After reading the topic I have a few questions about some of the statements made.
1. One poster mentioned that if you don't download 100% of a torrent (say, Dirty Harry) and delete it after you finish watching it, they can't pin anything on you since you technically didn't have the entire thing. In some sites like Demonoid, they usually come with a little .txt saying "downloaded from Demonoid", if you were to uncheck that download in utorrent and just download the movie files, would this method work?
2. Is linux more secure than windows when it comes to this? I know it's generally more secure than windows, but when it comes to encryption/secure file deletion is it superior to its windows counterparts? Or is it plagued by the same pitfalls as windows is when attacked by nerds armed with data retrieval software?

(Assuming you live in America...)
1) False. All they have to do is prove that you were downloading it at all.
2) Irrelevent. By the time you're in trouble, 'they' have everything they need from your ISP. Once you're caught, one of three things will happen: You'll be let off with a warning, you'll be asked to settle out of court for anywhere between $1000 and $100000 depending on the severity of the offense, or you'll be taken to court, which is when they'll take your computer. If you end up in situation 3, you're boned. Encryption is pointless if they have the ISP's logs (and they will) and failing to provide ALL passwords will default the case to 3-5 years in prison. If you fail to delete evidence properly, or there is evidence that you tried to, you will be given a MUCH harsher sentance. And while it is true that it takes longer for a system to get analyzed, it is only because there are fewer people trained for the job. And trust me, they know more about data recovery than you do about getting rid of evidence.
Other than not download illegally, what can we do? Or are you one of "Them"? >:o

educate people about the fact that downloading music and movies from file sharing networks is not illegal.
if the mpaa/riaa can't convince a jury that you did anything wrong, they can't legally do anything.

true, but that doesn't make the act of copyright infringement any less illegal if the mpaa/riaa can't convince a jury that you did anything wrong, they can't legally do anything.
