Let's say I wanted to distribute a program with OpenCandy. Would that make it malware/adware?

It will potentially give your program a bad reputation if it targets newbies and if it targets more experienced users, they'll just think you're a bit unethical. Make sure the defaults include the adware, it would be annoying if someone accidentally installed it. This is basically why I always go out of my way to always get archives or source code distribution as opposed to installers (on Windows), and if I'm forced to use an installer, I'll be unpacking it without actually running it, even if you try hard to make it difficult to unpack.

You program would be for Windows. So by definition it would be malware.
Target modern, open platforms such as GNU/Linux and Android instead.
