Since the heads of state of didn’t agree to a treaty of merger with the United States and Hawaii, Hawaii is still legally a sovereign politic according the US Constitution and international law. There is only a joint resolution in the books…essentially no such treaty of annexation of any form exists. Twice in Congress treaties of annexation (Not statehood btw) failed to pass.
