I've got to present a law paper on the legal and moral justifications for Guantanamo bay, any ideas?

First, write a paper on the legal and moral justification for hacking off the heads of non-combatants (or pows for that matter), for targeting women, children and other non-combatants with explosive devices, for kidnap, murder, rape, and arson contrary to the laws of both God and man. After that justifying a little detention  with watery lemonade should be fairly easy.
