Maybe, but have you considered that then when customer isn't breaking any laws, but seller/maker is it removes the typical trust that such transactions have. Anyone can buy CP and then bust the producer just for kicks. Then it would open possibility of pedos working together with police to bust producers for rewards and such. I know the producers are mostly located in countries where it's legal, but if we really want to stop CP we have to go against producers and not random people who download or buy it.
