Gun control issue:

It has been shown that the higher incidence of suicide and accidental death in homes with fire arms is more than double the incidences where the guns are used for self defence. Hard to argue that they should be used for self defence when they're more likely to blow your kids head off than blow off an intruder's head. So you argue that you're safer with your guns than the average. Fine, how do you suggest preventing the idiots? pass a test to bear arms? you'll find some formidable opposition to that one. anyway, some 20ish percent of children whose parents thought their kids didn't know they had a gun, knew, and had taken it out. Hard to hide things from kids.

Death penalty:

The death penalty has not been shown to reduce the incidence of 1st degree murder in the states that use it. In fact, the murder rates are higher on average in those states. The whole arguement for the death penalty is that it sends a stronger message to would be murderers than lesser punishment. This has not been shown to be the case, therefore the arguement collapses.
