Illehal downloading?

If its illegal and they know who it is (TPB) why do they have to have a court for it? or is that just to decide on how much it will cost them?

In Sweden the laws are different; they can't be found guilty for simply hosting a side in which torrents, which ARE legal, are uploaded by its members. The data contained in the torrents are what makes it legal or illegal, and it's not easy to find and arrest everyone who downloads a certain torrent or uploads it, nevermind how difficult it is to judge the amount and to prove it. An experienced user will have Peerguardian 2, CyberScrub Privacy Suite, and numerous other tools installed to protect themselves. It's quite a hard fight, and definitely a losing battle for the people sueing downloaders.

Why don't they just release movies on the internet, and use ads or let people pay online to watch?

For downloaders, most countries treat it under civil law, not criminal law, and so you are under risk of being sued by a complainant, and that's it.
