Right after Steven Harper says he would not use the notwithstanding clause, he asks him whether or not he would use the notwithstanding clause. He also claims he would have to because of a decision from the supreme court on same sex marriage.
Then after the debates, Harper mentions that the court actually said that the issue is up to the parliament to legislate. Martin is up before the press next and he was confused as whether he or Harper talked about the notwithstanding clause first! Not only that he repeats his error about the court's decision and stacks on some talk of "charter rights" nonsense on top of that flawed notion. Layton regurgitated a more wacko version of the erranous Liberal talking points but no one listens to him.
