実は、スパイを巡る法整備も完璧というわけではない。当局が事件を把握し、容疑者を確保、
法改正によって起訴まで持ち込めたとしても、そのことが逆に被害企業の首を絞める可能性もある。
現在の法律や運用では、刑事手続き、公判のプロセスの中で、盗まれた機密情報の内容自体が
マスコミの報道や起訴状などによって、公になってしまうこともあり得る。
米国などでは、非公開で刑事手続きを進めたり、法廷で機密情報の内容を隠しながら公判を
進めたりする仕組みがあるが、日本にはまだない。
改正不正競争防止法の成立時、この問題について検討する旨も付帯決議に盛り込まれたが、
改正法が施行される来年までに、機密を守る仕組みが運用される可能性は極めて低い。
