Evicted---legal advice

Name: Anonymous 2007-11-13 23:51

Hello all.  I am currently a college student and was kinda evicted from my residence over a month ago.

My roommates and I had a couple parties that were pretty crazy.  Security and the landlord came by at the first party and everyone left.  The second party we had, security came twice and told everyone to leave but some people did not listen and were disrespectful.  The police later showed up and warned us.

Our landlord stopped by the next day and told us we had to get out by the end of the month(which was in 15 days).  This is where it gets confusing.  Our landlord did not file for official eviction because he doesn't want our(roommates and I) records to be fucked.  It seemed like an honorable thing to do.

Now, the landlord says we owe him rent for October and November.  We moved out in September.  He said that its state law that if you're evicted you are responsible for rent until it is occupied by another tenet.  How does state law apply in this situation when we weren't officially evicted?  The whole situation seems very illegal to me.  He said that if it went to court, he was confident he would win(bullshit?)

Should I pay him?  I have reason to believe that he will file for eviction papers if I don't pay.  I am still friends with my ex roommates and they are going to pay.

Advice?

I wouldn't pay him anything.  If you're already out of the house, he can't go back and call a redo and make the eviction official.  It's his fault for not doing so.
