question about illegal downloading

Sorry for being dumb and I'm no computer or law expert, the question is:

If I download music or movie illegally or perhaps CP,ok? If everything I downloaded was free(i.e. no credit card record) then even if the police can seize my computer, in my home, how could they prove me did it but not my father or mother or my brothers if every one in my family can access the same computer?
They can't just sue every member of my family, right?

If there ever is such a problem, the owner of the PC gets in trouble unless there's proof otherwise.

So in your case, your father would probably be the one responsible, unless it's obvious the files in question are on your user account / only accessed by you / etc.

Its ok as long as its good CP the cops will just seize your HDD until they can copy the files to their own computers

Unless the police suddenly start doing random HDD inspections, there's no way to detect when something has been transferred to the HDD unless it's when it's being downloaded (ignoring the spyware factor).
With an IP, you can get an ISP. If someone with a warrant was to ask the ISP for personal data, the ISP would have to check who was using the IP at that time if it's dynamic IP or who has the IP if it's static.
Whose name do you think the ISP will have? The owner of the computer's or the owner of the connection's?
And the proof is not the presence of data on the HDD, but the act of download.

Now, if anything else was found in the HDD at the time, that's a different matter.
